Gallares Hospital dared to prove it owns lot

The provincial government of Bohol through the provincial board dared the Gov. Celestino Gallares Memorial Regional Hospital (GCGMRH) to prove that it owns the lot it’s now occupying.

 “For the Gallares hospital which has a clean title under the name of the provincial government of Bohol, if the Gallares family has a Deed of Donation as alleged, they have the burden of proof to prove in court that they own it,” reads the joint committee report.

 This contained in a joint report No. 2017-01 dated Jan. 16, 2017 of the committees on government properties, enterprises and ways and means delivered by Board Member Gloria Gementiza, chairperson of government properties committee during the session of the Sangguniang Panlalawigan presided over by Vice-Gov. Atty. Dionisio Balite, who later on, requested senior BM Atty. Benjie Arcamo to take the reign in presiding the session, last Friday.

 The said report tackled by the joint committees arose from the manifestation of Board member Atty. Tomas D. Abapo, Jr. regarding the letter of Gov. Edgardo Chatto dated November 9, 2016, “requesting for the passage of the Resolution granting to the Governor Gallares Memorial Hospital to build new buildings in the area owned by the provincial government for the said hospital project.”

DEED OF DONATION

FROM GALLARES FAMILY?

 In his manifestation, earlier, Abapo said that he was informed that the Gallares family donated the said lot for the hospital, including a portion of city airport, on condition that “if these areas are no longer used for the purpose, the owners will get back these parcels of land.”

 The lot occupied by hospital buildings consists of 11,951 square meters based on the original certificate of title (OTC) No. 181 issued on March 18, 1932 in the name of the provincial government of Bohol during the Commonwealth government.

 The committee report quoted Register of Deeds that the OTC under the name of the province “was not annotated nor any condition or deed of donation stated/attached therein hence, it is a clean title.

 The provincial government of Bohol also owns some 65,500 sq.m. or six hectares of the city airport lots with OCT No. 4876-220 issued on December 21,1937 during the Commonwealth government.

 The committee report said that the rest of the airport lots are partly owned by national government, Department of Public Works and Highways and Civil Aviation Authority of the Philippines (CAAP), formerly the Civil Aeronautics Administration and some individual owners.

 Some of the said airport lots were acquired from the private owners by the provincial government of Bohol “but not yet transferred yet annotated in the Transfer of Certificate of Title (TCT) that they were bought by the provincial government,” the report said.

 It appeared that, based on said joint committee report, no recommendation has been given by the provincial board for the hospital to build new buildings in the existing lot occupied by GCGMH.

 The second committee recommendation urged the General Services Office (GSO) to speed up the conduct of the survey, subdivision of the airport area and apply for TCT acquired from private owners in the name of the provincial government.

 Board Members Gementiza, chair of government properties; Abeleon Damalerio, agriculture committee chair; Dionisio Victor Balite, agriculture committee vice-chairman; and Elpidio M.
