A small delivery truck rammed through a residential gate in Dauis town at past 7 p.m. on Wednesday, police said.
There were no reported injuries during the incident but authorities said that the vehicle’s driver was under the influence of alcohol when he figured in the accident.
According to PO1 Benjie Ayana of the Dauis Police Station, Julius Odarbe, an employee of Alva’s Chicharon and Fried Chicken, slammed into the gate of one Pablio Loquias in Barangay Songculan.
Odarbe was heading towards Tagbilaran City during the accident and had just finished a drinking session at a convenience store near the site of the accident.
Anyana said that the driver was taken into police custody and was issued a traffic violation ticket for drunk driving.
However, no charges will be filed against Odarbe as the truck’s owner made an assurance to pay for the damages caused by the incident.
Anyana also noted that Odarbe could not be charged with violation of the Anti-Drunk and Drugged Driving Act due to the lack of a breathalyzer to officially prove that he was under the influence of alcohol.
The prosecutor’s office will not file the case before the court due to lack of breathalyzer results, he said. (A. Doydora)
